Agreement to these Terms
These Terms of Service (“Terms”) are a legal agreement between you and Movena LLC (“Movena,” “we,” “us”). They govern your use of movenalabs.com, BillyPocket, and any other website, app or service we provide that links to these Terms (together, the “Services”).
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services. Some products may come with extra terms; if they conflict with these Terms, the product-specific terms apply to that product.
Eligibility
You must be at least 13 years old to use the Services. If you're under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf. Some features, such as payments, may require you to be 18 or older. You may not use the Services if you're barred from doing so under applicable law.
Your account
Some Services require an account. You agree to give accurate information, keep it up to date, and keep your login credentials secure. You're responsible for all activity under your account. Tell us right away if you suspect unauthorized access. We may suspend or close accounts that violate these Terms or put the Services or other users at risk.
Subscriptions and purchases
App Store purchases
Purchases and subscriptions made in our iOS apps are processed by Apple and governed by Apple's terms. Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the current period, in your Apple ID settings. If you start a free trial, it converts to a paid subscription when it ends unless you cancel first. Apple handles refunds under its own policies.
Purchases made on the web
If we offer purchases outside the App Store, they're processed by our payment provider (such as Stripe). You authorize us and our provider to charge your payment method for the fees shown at checkout, including recurring fees for subscriptions until you cancel. Cancellation takes effect at the end of the current billing period. Except where the law requires otherwise, payments are non-refundable.
Prices and taxes
We may change prices. If we do, we'll give you notice before a change applies to an existing subscription. Prices may not include applicable taxes.
Not financial advice
BillyPocket and our other money-related tools are designed to help you organize and understand your own finances. Movena is not a bank, a money transmitter, or a registered financial, investment, tax or legal advisor, and nothing in the Services is advice of that kind.
Information in the Services, including balances, totals, categories and currency exchange rates, may be estimated, delayed or inaccurate, and is provided for general information only. You're responsible for your own financial decisions and for checking important information with your financial institution or a qualified professional. Where a payment feature relies on a third-party provider, that provider, not Movena, is responsible for processing the payment, under its own terms.
Your content
You own the information, photos and other content you add to the Services (“Your Content”). You give Movena a worldwide, non-exclusive, royalty-free license to host, store, copy, process and display Your Content only as needed to operate, secure and improve the Services for you, and as described in our Privacy Policy.
You confirm that you have the rights needed to add Your Content, and that it doesn't violate these Terms or the law. We may remove content that does.
Acceptable use
You agree not to:
- Use the Services for anything illegal, fraudulent or harmful, including money laundering or financing illegal activity.
- Infringe or violate the rights of others, including privacy and intellectual property rights.
- Access another person's account or data without permission, or impersonate anyone.
- Reverse engineer, decompile or try to extract source code, except where the law allows it.
- Interfere with or disrupt the Services, probe or breach security, or upload malware.
- Scrape, crawl or use automated means to access the Services without our written permission.
- Use the Services to build a competing product, or resell them without our consent.
Our intellectual property
The Services, including their software, design, text, graphics and logos, belong to Movena or our licensors and are protected by law. “Movena,” “Movena Labs,” “BillyPocket” and related logos are our trademarks. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial use.
If you send us feedback or ideas, we may use them without any obligation to you.
Third-party services
The Services may include or link to third-party services, such as the App Store, sign-in providers and payment processors. Your use of those services is governed by their own terms and privacy policies, and we aren't responsible for them.
Apple App Store terms
If you download one of our apps from the Apple App Store, you also agree that:
- These Terms are between you and Movena only, not Apple. Movena, not Apple, is solely responsible for the app and its content.
- Your license to use the app is limited to Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights.
- You confirm that you aren't located in a country subject to a US government embargo or designated as “terrorist supporting,” and that you aren't on any US government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to the Services
We're always improving, so we may add, change, suspend or discontinue any part of the Services at any time. Beta or preview features are provided as-is and may change or go away. Where a change materially affects a paid subscription, we'll give you reasonable notice where we can.
Termination
You can stop using the Services and delete your account at any time. We may suspend or end your access if you violate these Terms, if required by law, or if your use creates risk or legal exposure for us or others. The sections that by their nature should survive, including ownership, disclaimers, limitations of liability, indemnity and dispute terms, survive termination.
Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Movena disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don't warrant that the Services will be uninterrupted, error-free or secure, or that data will never be lost.
Limitation of liability
To the fullest extent permitted by law, Movena and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to the Services or these Terms. Our total liability for any claim relating to the Services or these Terms will not exceed the greater of (a) the amount you paid us for the Services in the 12 months before the claim arose, or (b) US $100.
Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless Movena and its members, managers, employees and agents from any claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, Your Content, or your violation of these Terms or the law.
Governing law and disputes
These Terms are governed by the laws of the US state in which Movena LLC is organized, and applicable US federal law, without regard to conflict-of-law rules.
If you have a dispute with us, please contact hello@movenalabs.com first. We'll try to resolve it informally within 30 days. If we can't, any claim must be brought in the state or federal courts located in that state, and you and Movena consent to their jurisdiction, except that either party may bring an eligible claim in small claims court. Nothing in these Terms limits any rights you have under mandatory consumer protection laws where you live.
Changes to these Terms
We may update these Terms from time to time. We'll post the new version here and update the effective date. If the changes are material, we'll give you notice through the Services or by email. If you keep using the Services after changes take effect, you accept the updated Terms.
General
These Terms, together with our Privacy Policy and any product-specific terms, are the entire agreement between you and Movena about the Services. If any part is found unenforceable, the rest stays in effect. If we don't enforce a right, we haven't waived it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Nothing here creates a partnership, employment or agency relationship. We may send you notices by email or through the Services.
